Bylaws of Data State Inspectorate 1

Issued according to
Article 20, paragraph 2 of
the Personal Data Protection Law.


1. Data State Inspectorate (hereinafter - Inspectorate) is state authority under supervision of Ministry of Justice.

2. The Inspectorate is legal entity. It has seal with supplemented small state blazon of Latvia and full title of the Inspectorate as well as account in The Treasury of The Republic of Latvia.

3. Personal Data Protection Law establishes the rights and obligations of the Inspectorate.

3.1. The Inspectorate according to the Electronic Documents Law is the supervision institution of the trusted certification service providers. 2

4. Officials of the Inspectorate are director, his deputies, heads of divisions and inspectors.

5. Director of the Inspectorate:
    5.1. Plans, leads and organises the proceedings in the Inspectorate and bears responsibility regarding it;

    5.2. Represents the Inspectorate without special authorization;

    5.3. Is responsible for the use of financial resources of the Inspectorate in accordance to the determined procedures and according to the purposes foreseen;

    5.4. Signs the decisions that the Inspectorate makes;

    5.5. Cancels any decision or order of the officials of the Inspectorate when they are in contradiction with legislation;

    5.6. Approves the structure of the Inspectorate and the list of employees within the frame of appropriation for salaries confirmed by annual law of state budged;

    5.7. Determines the rights and obligations of the officials and employees of the Inspectorate and confirms their job descriptions;

    5.8. Appoints and dismisses the officials of the Inspectorate of their duties, as well as hires and dismisses other employees of the Inspectorate of their duties;

    5.9. Organizes the training and improvement of professional skills of the officials and employees of the Inspectorate.

6. Officials and employees of the Inspectorate have official identity cards.

7. The property of the Inspectorate consists of fixed assets and current assets, as well as other belongings; their value is included in the balance of the Inspectorate.

8. The financial means of the general state budget form the financial resources of the Inspectorate.

9. Financial resources of the Inspectorate should be used for the implementation of the functions of the Inspectorate.

10. Regulation comes into force from 1 January 2001.
